NRI Property Sale in India — Capital Gains and TDS Refund

When an NRI sells property, the buyer in practice deducts TDS on the full sale price, not just on the gain, so a large part is often refundable. We compute your capital gains from the purchase and sale records, check exemption options and file the return that brings the excess back.

HomeNRI Property Sale in India — Capital Gains and TDS Refund

Who this is for

  • NRIs who sold a house, flat, plot or inherited property in India
  • NRIs whose buyer deducted TDS on the full sale value
  • NRIs planning to reinvest the gain and claim exemption

What is included — ₹10,000

  • Capital gains computation from purchase and sale records
  • Claiming refund of excess TDS deducted by the buyer
  • Exemption planning (Section 54 / 54EC) where eligible
  • Filing and refund follow-up

Documents we need

  • Sale deed and purchase deed (or inheritance documents)
  • Proof of purchase cost and of improvements, with dates
  • Buyer's TAN and PAN, and the TDS certificate (Form 16A) with Form 27Q details
  • Your PAN, passport and bank details for the refund
  • Details of any reinvestment (new house or 54EC bonds)

How it works

  1. 1. Gather purchase and sale records

Send the deeds, cost proofs and the buyer's TAN and TDS certificate details by email or WhatsApp.

  2. 2. Compute the capital gain

We work out the gain from your purchase cost, improvement cost and sale price, and whether it is long-term or short-term.

  3. 3. Plan the exemption

We check Section 54 and 54EC options and what you must do, and by when, to claim them.

  4. 4. File the return and claim the refund

We file the ITR with the TDS credit and claim the excess TDS as a refund.

  5. 5. E-verify and track

You e-verify the return and we follow the refund until it is credited.

Frequently asked questions

Why is the TDS on my property sale so high?

Without a lower-TDS certificate, buyers in practice deduct TDS on the whole sale price at the rate for non-residents, including surcharge and cess, not on the gain alone. Your actual tax is usually lower, and the difference is refunded when you file.

Can I avoid the high TDS before the sale?

Yes — a lower TDS certificate (Form 128) applied for before the sale can bring TDS down to your actual tax. See our lower TDS certificate service.

Can I send the sale proceeds abroad?

Generally yes, after the tax is dealt with, with Form 145 and, where required, Form 146 filed through your bank. NRIs can usually remit up to US$1 million per financial year. See our Form 145 / 146 service.
