The Rules in Plain Words
UAE Labour Law, as it stands in October 2026.
One year's service first
Gratuity is payable only after at least one year of continuous service with the same employer. Below one year there is no end-of-service gratuity.
21 days, then 30 days
You get 21 days' basic salary for each of the first five years, and 30 days' basic salary for every year after that. Part years count proportionately.
Basic salary only
Gratuity is worked out on your last basic salary — housing, transport, overtime, bonus and other allowances are left out. The daily wage is usually basic salary divided by 30.
Capped at two years' pay
However long you worked, total gratuity cannot exceed two years' wages. Unpaid leave days are not counted as service.
Resignation no longer cuts it
Under the 2021 law, gratuity is calculated the same way whether you resign or your employer ends the contract — the old one-third and two-thirds reductions no longer apply.
Different schemes
DIFC and ADGM employees, government staff, and companies that joined the voluntary end-of-service savings scheme follow different rules.
Frequently Asked Questions
How is gratuity calculated in the UAE?
Daily basic wage (basic salary ÷ 30) × 21 days for each of the first five years, plus × 30 days for each year after five. Part years count proportionately, and the total is capped at two years' wages.
Do I get gratuity if I resign?
Yes, if you have completed at least one year of continuous service. The new UAE Labour Law calculates gratuity the same way for resignation and termination.
Is gratuity calculated on basic or gross salary?
On the last basic salary only. Housing, transport and other allowances are excluded unless your contract says otherwise.
When must the employer pay gratuity?
Together with other end-of-service dues, within 14 days of the end of the employment.
Is my UAE gratuity taxed in India when I move back?
Usually not, if you receive it while you are still a non-resident or RNOR for Indian tax. The year of return matters — check your residential status before bringing large sums home.
