Cheque Bounce (Section 138): Notice, Time Limit aur Recovery

👤 Rajput Lalit & Associates📅 7 October 2026⏱️ 9 min read

Suresh ne apne ek customer ko ₹5,00,000 ka maal udhaar diya. Customer ne payment ke liye cheque diya, jo bank se "funds insufficient" likhkar wapas aa gaya. Suresh ne phone kiye, WhatsApp kiye, aur do hafte aise hi nikal gaye. Cheque bounce hone ke baad sabse bada nuksan aksar paise ka nahi, time ka hota hai, kyunki Section 138 mein har step ki ek strict deadline hai. Ye guide wahi deadlines, paise ka asar aur recovery ke raaste simple bhasha mein batati hai, taaki aap sahi waqt par sahi step le sakein.

Quick Summary

  • Cheque ki validity 3 mahine hoti hai (RBI directive), isi ke andar bank mein present karna hota hai
  • Return memo ki jaankari milne ke 30 din ke andar legal notice bhejna zaroori
  • Notice milne ke baad drawer ko 15 din milte hain payment karne ke liye
  • 15 din ke baad ek mahine ke andar complaint file karni hoti hai
  • Sazaa: 2 saal tak ki jail, ya cheque amount ka double tak fine, ya dono
  • Court interim compensation (cheque amount ka max 20%) bhi dila sakti hai

Section 138 Kab Lagta Hai?

Section 138 tab aata hai jab cheque kisi legally enforceable debt ya liability ke liye diya gaya ho, validity ke andar bank mein present hua ho, aur account mein paise kam hone ya arrangement se zyada hone jaise karan se bounce ho gaya ho. Court mein aam taur par ye maana jaata hai ki cheque kisi debt ke liye hi diya gaya tha (Section 139 ki presumption), aur ise galat saabit karna drawer ki zimmedari hoti hai. Ye presumption rebut ho sakti hai, isliye case-to-case facts matter karte hain.

Kuch bounce reasons, jaise account closed, signature mismatch ya stop-payment, par courts ka view facts par depend karta hai. Aur agar cheque security ke liye diya gaya tha ya underlying debt par vivad hai, to bhi case facts ke hisaab se alag ho sakta hai. Aise cases mein advocate ki salah pehle hi le lena samajhdari hai.

Timeline: Har Step Ki Deadline

StepDeadlineKya karna hai
1. Cheque present kareinCheque ki date se 3 mahine ke andarApne bank mein deposit karein. Validity ke andar dobara bhi present ho sakta hai.
2. Return memo milna-Bank se dishonour ka memo aur reason lein. Isi tareekh se 30 din ginte hain.
3. Legal noticeJaankari milne ke 30 din ke andarDrawer ko likhit notice: cheque ki details, bounce ka reason aur amount ki demand.
4. Drawer ka paymentNotice milne ke 15 din ke andarDrawer ko payment karna hota hai. Is dauran complaint nahi ban sakti.
5. Complaint file karna15 din khatam hone ke baad ek mahine ke andarMagistrate court mein complaint, documents aur affidavit ke saath.

Notice speed post / registered post se bhejein aur email bhi, aur postal receipt, tracking aur delivery proof sambhal kar rakhein. Notice milne ki tareekh aksar vivad ka mudda banti hai.

Ek Worked Example: Suresh Ke ₹5 Lakh Ke Cheque Ka Calendar

Ye illustration hai, exact dates ki ginti aur holidays ka asar advocate se confirm karwayein.

GhatnaDate (2026)
Cheque ki date (₹5,00,000)1 August
Bank se return memo ki jaankari12 August
Notice bhejne ki last date (30 din)11 September
Notice bheja gaya / drawer ko mila5 September / 8 September
Drawer ke payment ka 15 din ka window khatam23 September
Complaint ki outer limit (lagbhag, ek mahine mein)23 October

Suresh ke liye practical tip: last date par kaam chhodne ki jagah, window khulte hi complaint ki taiyari shuru kar dena behtar hai.

Paisa Aur Penalty: Kya Asar Hota Hai

ProvisionKya hai₹5 lakh ke cheque par example
Section 138 sazaa2 saal tak jail, ya fine (cheque amount ka double tak), ya donoFine ki upper limit ₹10,00,000
Section 143A interim compensationTrial ke dauran court, cheque amount ke maximum 20% tak, interim compensation dilwa sakti haiMaximum ₹1,00,000
Section 148 appeal depositConviction ke khilaf appeal mein, awarded fine ya compensation ka kam se kam 20% deposit karne ka order ho sakta haiAgar ₹6,00,000 compensation mili, to minimum ₹1,20,000

Interim compensation tab ban sakta hai jab drawer summary trial ya summons case mein "not guilty" plead kare, ya baaki cases mein charge frame hone par. Ye court ke discretion par depend karta hai. Section 143 ke tahat in cases ki sunwai aam taur par summary trial ke tareeke se hoti hai, jisme magistrate 1 saal tak ki sazaa de sakta hai. Aisa lage ki zyada sazaa banni chahiye, to normal trial hota hai.

Settlement Ka Raasta: Compounding Aur Naye Cost Guidelines

Cheque bounce ka offence compound ho sakta hai, yani dono parties samjhauta karke case khatam kar sakti hain. Reports ke mutabik Supreme Court ne 25 September 2025 ko Sanjabij Tari v. Kishore S. Borcar mein compounding ki cost ke naye guidelines diye, jo 1 November 2025 se lagu hone ke liye kahe gaye hain:

Payment kabAdditional cost₹5 lakh par
Defence evidence record hone se pehleKoi cost nahi₹0
Defence evidence ke baad, judgment se pehle5%₹25,000
Sessions Court ya High Court (revision / appeal) mein7.5%₹37,500
Supreme Court mein10%₹50,000

Reports ke mutabik isi judgment mein summons ki dasti (khud complainant ke through) aur electronic service ko bhi badhava diya gaya. Isliye complaint mein drawer ka email aur mobile number dena kaam aa sakta hai. Ye cost slabs aur directions ka exact use court par depend karta hai.

Cheque Lene Wale (Payee) Ke Liye Checklist

  • Cheque lete waqt invoice, delivery challan ya agreement ka record rakhein, taaki debt ka saboot rahe.
  • Cheque ki date, naam, amount, signature aur account details dhyan se check karein.
  • Cheque validity (3 mahine) ke andar hi deposit karein, aur deposit ka slip rakhein.
  • Return memo milte hi tareekh note karein, aur 30 din ka calendar turant set karein.
  • Notice mein cheque ki details, bounce ka reason aur demand saaf likhwayein.
  • Civil recovery ka raasta (jaise summary suit) bhi alag option hai. Advocate se raay lein.

Cheque Dene Wale (Drawer) Ke Liye Safe Practices

  • Cheque tabhi dein jab account mein paise honge ya aapko pakka pata ho ki paise aa jayenge.
  • Agar cheque bounce hua, to notice milte hi 15 din ka window yaad rakhein. Is dauran payment karne se complaint ka aadhaar nahi banta.
  • Notice ko ignore na karein. Dispute ho to likhit jawab dein aur advocate se salah lein.
  • Company ke cheque mein company aur wo log jo business ke incharge the, dono par jimmedari ban sakti hai (Section 141). Isliye directors / partners dhyan rakhein.

Common Mistakes

  • 30 din ko cheque ki date se ginna, jabki ye return memo ki jaankari se count hote hain.
  • Sirf phone ya WhatsApp par demand karna aur likhit notice na bhejna.
  • Notice par galat ya incomplete address likhna.
  • 15 din ke window ke baad complaint file karne mein ek mahine se zyada ki deri.
  • Ek hi dishonour par dusra notice bhejkar time-limit badhane ki koshish.
  • Galat jurisdiction (court) mein complaint file karna.
  • Cheque ke saath bina bill ya agreement ke udhaar dena.
